Laws of Inheritance - Islam Shows a Peaceful Settlement

Islam throws light on the subject of inheritance and holds it extremely important because fair division of assets among heirs leads to prosperity and blessings. We all know the lust people have for money, and if correct splitting is not done, it may lead to fights, relationship breakage and even killing!

The laws of inheritance revolve around the accurate allocation of the wealth, property and money of a person who is no longer alive. This wealth is to be disseminated among the inheritors and beneficiaries of the deceased person according to their will. Here are some laws of inheritance stipulated by Islam:

· A Muslim can’t inherit from a non-Muslim and vice versa.

· A greedy person murdering someone just to get the inheritance would be denied of the inheritance.

· When a person dies, their complete wealth (money or property) will be automatically transferred to their successors, apart from the donations the person had made.

· The heirs will be identified after the person’s death.

· The amount of share each heir would get is explicitly given in the Holy Quran.

· The heirs may own and use their received share however they wish to.

· If a person wishes to favor any one particular heir with more wealth than the rest, they may do so during their life span.

· A donation not more than one third of the wealth may be given to a non-heir or any other welfare organization.

· The division of wealth may be done after the entire funeral expenses have been covered and the remaining debts have been paid off.

· Providing food to the funeral attendees is not inclusive in the funeral expenses and can’t be paid for from the deceased wealth.

These laws of inheritance in Islam possess a unique status and our beloved Prophet Muhammad (PBUH) says: "Learn the laws of inheritance and teach it to people, for it is half of knowledge". Thus, these laws must be learned and properly spread ahead to avoid the betterment that may arise between family members over the estate.
